Overview

Pockethunt is an internet and mobile application based service offered for compatible devices (hereinafter referred to as the “Service”). Using this service, individual professionals and freelancers (“Professionals”) and individual recruiters (“Recruiters”) can save information about themselves and/or the company they represent in profiles. The Service is used by either Recruiters searching and interacting with suitable employees and/or candidates, or by Professionals searching and interacting with recruiters. More information about the Service is available on the public website pockethunt.com (“Website”) or by registering as a user of the Service.

About us

This Service is provided by Pockethunt Oy (hereinafter “Pockethunt”, “we”, “us” or “our”). The company is registered in Finland with Business ID 2685292-2 and our official address is Itämerenkatu 5, FI-00180 Helsinki, Finland. We provide professional recruiting, networking and communication services using digital interaction and mobile technology (“Services”).

Terms of use

These Terms and Conditions of Use (including documents that refer to these) concern all users of the Service and are legally binding. You must read and accept these Terms and Conditions of Use before using the Service. By using the Service, you are providing your approval of these conditions and commit to adhering to these conditions. If you cannot accept all the Terms and Conditions of Use or you are unable to adhere to these, you shall not use the Service.

Code of Conduct

Our Code of Conduct exists to ensure a safe platform for our users to post content and communicate with each other. These rules apply to all users who agree to our Terms and Conditions of Use.

Safety Rules

  1. Harassment and abuse: No targeted harassment of individuals or incitement of other people to do so.
  2. Hateful conduct: No promotion of violence against, threats against, or harassment of other people on the basis of race, national origin, ethnicity, sexual orientation, gender, religious affiliation, age, disability, or serious disease.
  3. Privacy: No sharing of personal information of other people without their expressed consent.
  4. Authenticity: No impersonation of individuals, groups of people or organizations in a manner that misleads or deceives others.
  5. Violence: No threats or glorification of violence against individuals or a group of people.
  6. Graphic and sensitive content: No sharing of violent, gory or adult content.
  7. Illegal goods or services: No use of the Service that promotes or furthers use or sales of illegal or regulated products or services.
  8. Intellectual property: No violation of other people or organizations’ intellectual rights such as trademark or copyright.

Poster Content Rules

These rules exist to ensure a minimum level of quality of content in Pockethunt. Posters that don’t comply with any of the following rules can be removed without notice:

  1. Posters are only for employers to promote their job opening or continuing recruitment need. Posters are not to be used to promote your personal career development.
  2. No posters that are clearly not for recruiting/networking purposes.
  3. No posters for recruiting purposes where entrepreneur-based distributors are sought, such as representatives for online or multi-level marketing, pyramid schemes, direct selling or similar business or marketing forms.
  4. No posters that do not display a real recruiter name and company name.
  5. No posters that have intimidating, harassing, abusive, discriminatory, derogatory or demeaning content.
  6. No posters that break any of the before mentioned Safety Rules.

Receiving rights to use the Service and using the Service

Receive rights to use the Service as a Professional by:

  • Registering yourself for the Service and entering the compulsory fields in the registration form.

Alternatively, you may be given rights to use the Service via other services provided by Pockethunt or its partners.

To be eligible to receive rights to use the Service, you must

  • Be at least 17 years old, in order to register a Pockethunt profile;
  • Commit to providing honest and correct personal information during registration, and always informing us if your personal information changes;
  • Understand that the Service only functions in the geographical locations (“Domain”) where it has been advertised as operating. Under no circumstances shall Pockethunt be held liable for any costs, infringements or other matters, such as damage compensation caused by you using or attempting to use the Service outside of its Domain;
  • Use the Service solely for personal and private intentions;
  • Make sure you have the use of an appropriate mobile connection and/or broadband internet connection that you pay for;
  • Refrain from using the Service in any illegal or inappropriate manner, and make sure nobody else does.

Receive rights to use the Service as a Recruiter by:

  • Registering yourself for the Service and entering the compulsory fields in the registration form.

To be eligible to receive rights to use the Service as a Recruiter, you must

  • Work in a company or organisation or work for an agency you represent in the Pockethunt Recruiter profile (“Employer representative”)
  • Commit to providing honest and correct personal information as the Employer representative, as well as company and/or organisation information (“Company”) during registration, and always informing us if your information changes;
  • As the Employer representative, commit to using the Service exclusively as a Recruiter and assure that you have the appropriate rights and authorisation for doing so;
  • Commit not to use the Service for recruiting purposes where entrepreneur-based distributors are sought or acquired, or representatives for online or multi-level marketing, pyramid schemes, direct selling or similar business or marketing forms;
  • As the Employer representative, commit to using the Service precisely for the recruitment, competence mapping or acquisition requirements of the Employer, and assure that you mention yourself as an agency representative if you use the Service for commercial of non-commercial recruiting, staff hire/resourcing or other similar manpower agency requirements of your own organisation or for any third party (hereinafter referred to as “Manpower agencies”). If you use the Service for the abovementioned purposes, you agree that Pockethunt can alter the Pricing and Contractual Terms for Manpower Agencies at its own discretion and whenever it sees fit, in which case you have the right to terminate the agreement in accordance with the section "Terminating the Service".*;
  • Understand that the Service only functions in the geographical locations (“Domain”) where it has been advertised as operating. Under no circumstances shall Pockethunt be held liable for any costs, infringements or other matters, such as damage compensation caused by the user using or attempting to use the Service outside of its Domain;
  • Make sure you have the use of an appropriate mobile connection and/or broadband internet connection that you pay for;
  • Refrain from using the Service in any illegal or inappropriate manner, and make sure nobody else does.

*Pockethunt Oy has the right to enter into agreements with commercial or non-commercial recruitment and staffing agencies. In this case, the agreement and Service details will be agreed separately on a case-by-case basis.

Parties adhering to the agreement and terms of use

The parties adhering to the agreement and terms of use are the Employer representative and Pockethunt. The Employer representative is not entering a contractual relationship on behalf of the Company, rather as an individual who intends to utilise the Service for professional recruitment purposes, but with the consent and approval of the Company. The same Company can have a number of Employer representatives present in the Service.

Purchases

Our Service may offer products and services for purchase (“Premium Features”) through iTunes or Google Play as in app purchases, or other payment platforms authorized by us. If you choose to make an in app purchase, you will be prompted to confirm your purchase with the applicable payment provider, and your method of payment (your credit or debit card, or a third party account such as Google Play or iTunes for in app purchases) (your “Payment Method”) will be charged for the in app purchase at the prices displayed to you for the Premium Features you've selected (prices include applicable taxes, unless otherwise mentioned). By confirming your purchase, you authorize our Service or iTunes or Google Play (“IAP Account”) to charge you and we form a billing agreement (“Billing Agreement”)

If you purchase an auto-recurring periodic subscription (“Subscription” or “Subscriptions”) through an in app purchase, your IAP account will continue to be billed for the Subscription until you cancel. After your initial Subscription commitment period, and again after any subsequent Subscription period, your Subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing.

Auto-renewal

Subscriptions are automatically renewed, until you terminate or cancel the subscription. When you purchase a subscription, your Payment Method will continue to be billed at the start of each Subscription period of the date of the initial purchase at the price and Subscription term (your “Plan”) you agreed to when initially subscribing. Your card payment information will be stored and subsequently used for the automatic card payments in accordance with the Billing Agreement.

After each payment you will receive a receipt by email. Objections to a payment already made, should be directed to customer support if you were billed directly by our Service or the relevant third party account such as iTunes or Google Play. You are also able to object by contacting your bank or payment provider, who can provide further information on your rights as well as applicable time limits.

Cancelling

You may unconditionally withdraw your consent to automatic card payments at any time by going to settings in our Service or the relevant third party account, but be advised that you are still obligated to pay any outstanding amounts. If you’re using an IAP Account, you can cancel your Subscription in your IAP Account menu, the section labeled “subscriptions” or similar.

Deleting your profile on Pockethunt or deleting the application from your device does not terminate or cancel your Subscription; Our Service will retain all funds charged to your Payment Method until you terminate or cancel your subscription on your IAP account. If you terminate or cancel your subscription, you may use your subscription until the end of your then-current Plan, and your subscription will not be renewed after your then-current Plan expires.

Failure to pay the fees for Premium Features will result in the termination of your Premium Features.

Alterations and changes in features and fees

We may change, remove or add services and features to the Premium Features from time to time. We may also change our fees for Premium Features from time to time. You acknowledge our right to make such changes and agree that such changes do not entitle you to a refund of the fees paid for the Premium Features.

Discounts and offers

From time to time, we may offer initial discounts on Subscriptions for a limited time. Discounts and offers are displayed in the application, and if you choose to purchase a discounted Plan as your first Subscription, you acknowledge that regular pricing will apply upon the next subsequent Subscription renewal.

Professional data insights

In our Service you may be able to purchase a limited, personal, non-transferable, non-sublicensable, revocable license to view personalized professional data insights, including, but not limited to, Your Professional Market Value, Your Uniqueness, Your Salary Comparison, Your Market Demand and Your Skill Demand (collectively, “Insights”). Insights is a part of Premium Features and the country availability for these Insights are displayed in the application prior to in app purchases of any Plan.

Insights shown in your profile is a limited interpretation of data collected anonymously from other users in our Service. It is not necessarily an accurate real-world representation of your professional value or labour market demand, and thus, we are not responsible for the accuracy and up-to-date status of the visualized data. It is also possible that we can not provide some or any of the Insights due to factors like your country restriction, complexity of your profile (such as profiles with very niché skill selections), or other similar reasons where there is limited or no data available to calculate and visualize your Insights data.

You acknowledge that Pockethunt or any third party is not accountable for the provided insights, nor required to provide a refund or other compensation due to inaccurate, misleading or lacking Insights data, or due to your general dissatisfaction of the provided Insights data.

Changes in your Payment Method

You authorize us to obtain updated or replacement expiration dates and card numbers for your credit or debit card as provided by your credit or debit card issuer. The terms of your payment will be based on your payment method and may be determined by agreements between you and the financial institution, credit card issuer or other provider of your chosen payment method; and

We may calculate taxes payable by you based on the billing information that you provide us at the time of purchase.

Refunds for Premium Features

Generally, all charges for purchases in our Service are nonrefundable, and there are no refunds or credits for partially used Plans. We may make an exception if a refund for the fees that you paid for Premium Features if you request the refund within fourteen days of the transaction date and you reside in the European Union (EU) or European Economic Area (EEA), or if the laws applicable in your jurisdiction provide for refunds.

To request a refund:

If you subscribed using your Apple ID, refunds are handled by Apple. To request a refund, go to iTunes, click on your Apple ID, select “Purchase history,” find the transaction and hit “Report Problem”. You can also submit a request at https://getsupport.apple.com.

If you subscribed using your Google Play Store account: please contact our customer support with your order number for the Google Play Store (you can find the order number in the order confirmation email or by logging in to Google Wallet).

Devices, systems and usability

Your possibilities for using the Service depend on whether you are using compatible devices, systems and connectivity. Before registering for the Service, you must make sure and test that you have all the devices, systems and connectivity that are required for proper use of the Service.

We may occasionally decide with which devices the Service will be compatible.

Please understand that the availability of the Service can be affected by congestion on the data networks or by other network, ISP, electrical, computer or other communication problems or faults, and that Pockethunt shall not be held responsible for unsuccessful use of the Service due to cases of congestion, problems or faults.

Username and password security

When registering, you can alternatively choose to register with your email. You are asked to provide your email address as your username and to choose a password. You must keep your password confidential and never disclose it to a third party. Only you are entitled to use your username and password, and only on one device (e.g. computer or smartphone) at a time.

At any time with reasonable warning, Pockethunt is entitled to request you to change your password. Please understand that this change can temporarily interrupt your access to the Service.

If you suspect someone else is using you username or password, you must inform us immediately and change your password. If Pockethunt has reason to suspect that a username and/or password has been disclosed to an unauthorised individual, or these have otherwise been misused by an unauthorised individual, Pockethunt is entitled to immediately cease provision of the Service and/or will terminate your rights to use the Service, or will engage in any other means to prevent the continuation of the unlawful activity.

Service alterations

At its own exclusive discretion, Pockethunt can alter the content of the Service.

Interrupting rights of use and removal of profile by Pockethunt

At any time, Pockethunt is entitled to interrupt your use of the Service or remove your profile. Special reasons for interrupting the service or removing the profile can be if:

  1. you are using or suspected of using the Service in an illicit manner,
  2. you fail to comply with these Terms and Conditions of Use.

Furthermore, Pockethunt reserves the right to demand damage compensation if Pockethunt incurs damages as a consequence of the infringement of items 1–2 above.

Intellectual property rights

The entire content of the Service is protected in accordance with the laws of Finland or other nations. All copyrights and other intellectual property rights for material, documents, data or content forming the Service belong to Pockethunt. Pockethunt grants you a licence with such rights solely for personal and private purposes (not for any commercial purposes) with the condition that with the exception of service properties intended for the users of the Service, you will not

  1. copy, publish, duplicate, hire-out, inform, send, distribute, forward or make the content of the Service publically available or authorise anybody else from doing such;
  2. Processing orders, billing and payment control
  3. download, forward or share any of the content of the Service, use the Service on any device not registered, or charge any fees for viewing the Service;
  4. twist, convert, remove, reverse engineer, back translate, deconstruct, alter or otherwise tamper with any security, encryption or other technologies or software that are a part of the Service.

No proprietorship rights to the Service or any of its content will be transferred to you.

Infringement of these conditions and intellectual property rights is always treated as a serious infringement of these Terms and Conditions of Use, thereby entitling Pockethunt to immediately shut down your access to the Service and/or remove your rights to use the Service, or to engage in any other means to prevent the continuation of the unlawful activity.

Security

You shall not attempt to bypass the security system of Pockethunt or the Service or test the security of the Service.

You shall not use the Service in any way that can cause damage, close, overload, harm or compromise other uses from using the Service. This covers all sending or forwarding of material that contains software viruses or other computer codes, files or applications that have been designed to damage, interrupt, harm, destroy or restrict the operation of any computer software or device that is either directly or indirectly associated with the Service.

You shall not attempt to gain unauthorised access to any computer system, network, content or data that form the composition of the website, Service or Service systems. Furthermore, you shall not attempt to gain access to material or data that is not intentionally made available by or through the Service.

Infringement of the above conditions is always treated as a serious infringement of these Terms and Conditions of Use, thereby entitling Pockethunt to immediately shut down your access to the Service and/or remove your rights to use the Service, or to engage in any other means to prevent the continuation of the unlawful activity.

Our responsibility

The Service is provided “as it is” and we hold no responsibility for the flawless or accurate nature of the content, information, Service or material provided by or via the Service.

Pockethunt shall not be held responsible for damages that are caused by using services offered by third parties by or via the Service or Website.

Compensation in situations of contractual infringement

If you infringe these Terms and Conditions of Use or the regulations of currently valid legislation, and your infringement leads to damages incurred by Pockethunt, you are obliged to compensate Pockethunt in full for any and all such damages.

Data Protection Practice

We process your information in accordance with our data protection practice (more information about our data protection practice in our Privacy Policy). By using the Website or Service, you agree to this processing.

Social media

The Service may provide you with the opportunity to publish your profile, share links with other users, and the linking of your Service-related actions on social networking services provided by third party organisations – including but not limited to Facebook, LinkedIn and Twitter (“Social media”) functions. If you decide to use this facility and link the Service to your Facebook account, your Pockethunt profile may become public for other users to view. You hereby accept that Pockethunt is no longer responsible for content when it has been shared on Social media and you must read more information regarding the conditions for using the Social media provider in question. If you use Social media in connection with the Service, you commit to refrain from using the service in any way that is regarded exclusively by us to be inappropriate, including (but not limited to) the following:

  1. Any disrespectful behaviour, harassment, intimidation, or violation against another user, impersonating another person and sending trash mail to other users.
  2. Any publishing or creation of offensive, abusive, derogatory, pornographic or indecent material.
  3. Use in any other illegal, immoral or adverse purposes.
  4. Infringement of the rights of any other third party.

This Website may contain links to websites owned by third parties. Pockethunt does not monitor the contents of these websites and therefore is not responsible for these or any losses or damages that can be incurred by the use of such.

If any conflict arises between Pockethunt and the consumer, the parties shall primarily attempt to resolve the conflict by mutual agreement. If the parties fail to reach an agreement, the conflict shall be exclusively resolved by the Finnish court system. Regardless of the above, the consumer always holds the entitlement to take the case up with the Consumer Complaints Board in accordance with Finland’s Consumer Protection Act.

Alterations

Pockethunt reserves the right to alter these Terms and Conditions of Use or make additions to these by altering the Website.

Pockethunt recommends that you stay up to date by regularly visiting the Website. All significant alterations/additions will also be notified to you via email.

Assigning the agreement to a third party

This agreement is only valid for individual customers and the user shall not assign this agreement or any of its rights or related responsibility to any third party. Pockethunt holds the right to assign this agreement or any part of this agreement to a third party.

Full agreement

These Terms and Conditions of Use together with the data protection policy (Privacy Policy) of Pockethunt form a full agreement between you and Pockethunt, and replaces all earlier written and verbal agreements related to the content of this agreement.

Force majeure

Pockethunt is not to be held liable if the Website or Service does not function, is not available or has a fault, or for any delays in adherence to these Terms and Conditions of Use if the aforementioned are caused by any instance that is beyond the reasonable control of Pockethunt. The above also concerns a situation whereby a potential subcontractor of Pockethunt has experienced the abovementioned force majeure, and Pockethunt was unable to rely on an alternative subcontractor.
